Terms and Conditions of The Outdoor Adventure Company (Kendal) Limited Booking procedures Health and safety guidance Children 18yrs and younger must be accompanied by a parent or guardian on site and on activities. You must not take part in activities if the following applies to you or any one in your party. You must ensure all participants are made aware of this information You are Pregnant, have had a recent or ongoing Back/Spine or neck injury. Have had a recent heart attack or stroke. Suffer from any other medical conditions which effects your motor skills CLOTHING REQUIREMENTS AND OTHER FACTORS: Correct footwear is ESSENTIAL e.g. walking boots or wellington boots should be worn when taking part in activities. Old warm clothing (preferably layered) are also recommended in all weathers. In summer it is also recommended to carry sun hat and lotion and in winter to bring hat, scarf and gloves. Waterproof jackets and legging are advisable as activities can be wet and muddy, obviously depending on weather conditions. The Outdoor Adventure company excepts no liability due to slips trips and falls or any other injury sustained by your/other party members negligence on and around the site. You must ensure correct footwear to avoid such issues when entering the site and be mindful of other participants using the site. The outdoor adventure company will not tolerate any abuse physical or verbal, racist behaviour or any other act which can cause harm to any members of staff or other activity centre users, guests or other. By securing your Booking with us you also agree to the Terms and conditions stated above and below in their entirety. Bookings will only be taken on receipt of a 50% deposit as security unless agreed otherwise. This must be made within 48 hours of the provisional booking being placed. Deposit
Balance 1. The balance is due no later than 7 days prior to the event. Cancellations In the event of a client cancelling or altering the original number of the booking the Outdoor Adventure Company (Kendal) Limited retains the right to recover the cancellation charges:- More than 7 days prior to the event ….. Loss of 50% deposit only Less than 7 days prior to the event ……. 100% of total fee payable Non arrival by a client on the event date as outlined on the Booking Form or a reduction in party numbers will be treated as a cancellation. If we have to cancel the Event due to bad weather or any other unavoidable circumstances the booking will be rescheduled to a mutually agreed alternative date within three months after the original date booked for the Event. Should you choose not to accept the rescheduled date no refund or other compensation will be offered by us and we will be deemed to have fulfilled our agreement. A decision made by any person not to take part in the Activities in any circumstances (including, but not limited to, bad weather) will be deemed to be a cancellation. Unforeseen circumstances may delay the start of the Event. In all cases we will endeavour to minimise inconvenience and will offer you a later start time. Should you choose not to accept a later start time offered to you no refund or other compensation will be offered by us. Insurance We have public Liability Insurance NOT personal accident cover. Our Activities can be dangerous. Whilst the Activities are as safe as they can be given their inherent physical dangers, it must be understood that all safety instructions, directions, warnings and all other instructions must be followed at all times. You are advised not to attempt to go beyond your capabilities or engage in risky or daring behaviour. All the Activities by definition involve an element of risk so you take part in the Event with the full understanding of this and accept responsibility for your own safety and the risks involved in taking part together with that of any minors for whom you have responsibility. In the case of more than one person taking part under a booking all individuals in the group will be deemed to have acknowledged the possible risks involved and agreed to take part on this basis. Management reserve the right to STOP any person participating in activities/event if they are unruly, deemed not capable, do not follow rules set out by Instructors or are under the influence of alcohol or drugs. NO REFUND WILL BE GIVEN. Exclusion of liability The Outdoor Adventure Company ltd (Kendal) shall not be liable for any death or personal injury of the client, recipient or third party unless it was due to the negligence of The Outdoor Adventure compony ltd (Kendal). The Outdoor Adventure Company ltd (Kendal) shall not be liable for damage to property, consequential losses or expenses suffered, which includes but not limited to the loss of anticipated earnings, profits, goodwill, reputation, business, receipts or contacts, losses or expenses resulting from 3rd party claims. The Outdoor Adventure company ltd (Kendal) is not liable for damages to vehicles on site. The Outdoor adventure Company is not liable to slips trips and falls on and around the site, by the very nature of our Outdoor activities held on our site the ground is uneven, rocky and parts of the site are kept in its natural state to preserve the natural wild life in the area. You and any accompanying party entre the site at your own risk only and are advised before and after booking the correct footwear and clothing to minimis accident or injury. Responsibilities for equipment provided All Participants are responsible for the proper care and handling of Equipment and gear that they are supplied with for use on the event day. Any misuse, damage or loss of this equipment will result in charges for repair or complete replacement at the desecration of The Outdoor Adventure company ltd (Kendal) Late Arrivals If clients arrive later than the designated Start Time as stated in the Booking form, The Outdoor Adventure Company (Kendal) Limited reserves the right to adjust the session time allocated to incorporate the original finish time. Medical Details If you have any medical issue that you are concerned about must be discussed with the Instructors and disclosed on our disclaimer forms. Privacy Policy The Outdoor Adventure Company Kendal LTD will not share use or store any of you information by any means. Social Media we make take photos for our social media pages. if you do not wish for your photo to be taken please let the instructors know. if you are happy for us to share images on social media please sign the consent forms on arrival. Overview As we (The Outdoor Adventure Company ltd Kendal) take complete care to ensure safety of equipment, site maintenance and adequate safety briefing, you are responsible for your own safety and the safety of others around you. It is also your responsibility to read and understand the terms and conditions set out before you. it is your responsibility to adhere to all rules and regulation while you are on site set out in the terms and instructors. Any misuse of substance, alcohol or un sociable behaviour to other patrons, your team or instructors will result in being escorted off site.
